RE: The tariff classification of rattan wastebaskets from China

Dear Ms. Chronopoulos:

In your letter dated June 2, 2008, on behalf of the importer, Lamont International Ltd., you requested a tariff classification ruling.

Samples of two styles of rattan wastebaskets were submitted to be classified. The samples will be returned to you as you requested.

Item RT103 is a cylindrical step can measuring approximately 11” high x 8 ½” in diameter. The step can consists of a basket with an attached lid that opens and closes by stepping on a mechanism on the bottom. A removable plastic pail fits inside the basket. The sides of the basket and the lid are made of rattan rods, approximately 2 mm in diameter, interwoven together in a decorative pattern. The step can with the plastic pail is a composite good composed of different materials and components. The essential character is imparted by the rattan rods which make up the bulk of the article.

Item RT630 is an open wastebasket with tapered sides, measuring approximately 9 ¾” high x 9 ¾” in diameter at the top and 7 ½” in diameter at the bottom. The basket is constructed of rattan rods, approximately 5 mm in diameter, placed horizontally parallel and woven together with vertical narrow rattan strips. The essential character of this basket is imparted by the rattan rods which make up the bulk of the article.

The applicable subheading for the rattan step can, item RT103, and the rattan wastebasket, item RT630, will be 4602.12.1400, Harmonized Tariff Schedule of the United States (HTSUS), which provides for: Basketwork, wickerwork and other articles, made directly to shape from plaiting materials or made up from articles of heading 4601: Of vegetable materials: Of rattan: Other baskets and bags, whether or not lined: Wickerwork. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
